Seller's Obligations

1. Seller will be held responsible for the accuracy and completeness of all descriptions of vehicles they offer for sale on the PBG website including

a. For Sellers located in Ontario It is the responsibility of the Seller to ensure that the vehicle is called correctly under the Motor Vehicles Dealers Act (MVDA), 2002. If a Seller fails or refuses to comply MVDA disclosure requirements the Seller will be held liable for all losses, costs and damages, including legal fees and any losses on the resale of the Vehicle. In addition, the Seller's auction privileges at PBG may be temporarily or permanently suspended at the discretion of PBG.

b. All images and text representations made by Seller, or seller's agent including 3rd party condition reports at the time of sale.

c. Actual images of the listed vehicle must be used unless proper disclosure is noted by the Seller which makes it clear the actual vehicle is Not Shown.

d. Correct year, make, model, odometer reading and equipment.

e. Announced conditions, and any defect or damage that is "visible" in nature including, but are not limited to; paintwork, dents, scratches, tire conditions, mismatched tires, interior damage, structural damage repaired or altered and inoperable accessories.

f. Disclose damages with internal repair costs totalling in excess of $500.00.

g. Title Discrepancies must be disclosed including but not limited to; branded salvage, branded rebuilt, branded irreparable vehicle, theft recovery, not actual miles, odometer replacements and flood/fire history.

h. Announce any known provincial, state or other governing locality fees and taxes over $100.00 due on the vehicle.

i. Vehicle submitted must have the correct VIN numbers on the vehicle and vehicle registration. Be registered to the seller and clear of all liens and encumbrances.

j. Announce previously voided OEM warranties on vehicles within OEM mileage/age warranty limits.

2. Seller must produce within 5 business days of the purchase date a negotiable/marketable Vehicle Registration clear of title to PBG. The seller further understands that transportation arrangements will not be made until appropriate ownership changes have been made.

3. The Seller is responsible for reimbursement of all reasonable documented expenses incurred by the Buyer on vehicles arbitrated for unannounced conditions. Expense reimbursements will be at the sole discretion of PBG and will at times be limited to reasonable and documented expenses and transportation only.

4. Seller shall be solely responsible for repurchase of any vehicle sold through PBG.com found to be stolen prior to the date of sale.

5. All multipurpose and utility-type vehicles are assumed to be 4x2 unless otherwise announced. However, if a 4x2 multipurpose, utility-type vehicle or pickup has been altered in appearance or stance to resemble a 4x4, a 4x2 announcement will be required.

Buyer Obligations:

1. As to any vehicle purchased in full on PBG, the Buyer is responsible for the following:

a. Inspect the vehicle immediately upon receipt at Buyer's location.

b. Verify the Seller's representations and notify PBG immediately of any discrepancies within the time frame as stated in this arbitration policy.

c. Verify odometer reading upon arrival at Buyer's location. Mileage must be as stated when purchased making allowance for normal delivery scheduling and transportation not to exceed 1,500 kms if arbitrating for inoperable or incorrect odometer. (Stated variance in the case of a Factory Order will be disclosed on digital images or items listed in the descriptions, condition data or announced conditions).

d. Note any obvious damage on the "Vehicle Delivery and Release From" prior to taking delivery of purchased vehicle.

2. The Buyer will inform PBG immediately of any discrepancies as to Seller's representations, warranties, and descriptions. Arbitration will be limited to the specific defects described by the Buyer upon placing the vehicle in arbitration.

3. Buyer agrees to have sufficient funds on deposit for all transactions made in the bank account designate for electronic funds PULL transfers as delineated in the dealership enrolment agreement. The Buyer further agrees that until transfer has been made, the Buyer shall acquire neither title to the vehicle nor any right to sell or offer for sale the vehicle purchased.

4. Buyer agrees to be liable for any and all work done to a vehicle prior to returning the vehicle to PBG except on vehicles arbitrated for unannounced conditions not detectable through vehicle inspection (i.e. stolen vehicle, odometer, Vehicle Registration discrepancy).

5. Buyers should thoroughly check and test drive every vehicle. If there is any problem, a complaint must be properly filed with the Arbitration Office of PBG within the established arbitration time limit. The Buyer assumes responsibility for mechanical failure once the arbitration period is over.

6. It is the Buyer's responsibility to review all images and understand all announced conditions, descriptions and condition data before placing bids/Buy Now. Once the vehicle is sold the Buyer should review the Purchase Confirmation for completeness. PBG will not arbitrate for defects visible in the digital images or items listed in the descriptions, condition data or announced conditions.
